Construction (Design and Management)
History shows that the construction industry has among the highest rates of injury and work-related health problems in the country. The number of fatal injuries in the industry is three times higher than the pan-industry rate.
Since 1994 there has been a requirement for construction professionals and workers to adhere to various versions of the Construction Design and Management Regulations which were designed to reduce accidents and promote a safer working environment in Construction. The Construction (Design and Management) Regulations 2015 (“CDM 2015”) replaced the previous CDM 2007 Regulations on the 6th of April 2015.
CDM 2015 applies to all construction work including domestic projects. The regulations also cover other health and safety requirements, such as security, traffic, toilet facilities, emergency procedures and lighting.
These Regulations differentiate between domestic and commercial clients. A domestic client is any individual who is having construction work carried out on their home, or the home of a family member. Domestic clients' responsibilities under CDM 2015 are normally transferred to the designer or contractor on a project involving only one contractor. Where more than one contractor is involved in a project, those responsibilities may be transferred to the main contractor.
A commercial client is one who carries out a construction project as a business transaction. These have influence over how projects are managed, including the management of health and safety risks. Whatever the project size, the commercial client has contractual control, appoints designers and contractors, and determines the resources required by the project.
A designer is the organisation or individual whose business is the preparation or modification of designs for construction projects. Designs include drawings, design details and materials specifications, bills of quantity or design calculations. Designers are often architects, consulting engineers or quantity surveyors.
If a project lasts more than 30 working days and has more than 20 workers working on site at any one time, or involves more than 500 person days it will come under CDM 2015 regulations. Should this be the case, the client has a responsibility to notify the Health and Safety Executive.
Non-compliance with the CDM Regulations can result in unlimited fines, or even imprisonment for the most serious breaches.
Before appointing a contractor you should ensure that your chosen supplier has satisfactory qualifications, experience and insurance, to provide the level of service that you require.
