Legionnaires’ disease is the most serious of the Legionellosis diseases. Legionnaires’ disease is a potentially fatal form of pneumonia and anyone can be infected by it but those who are most at risk are people over 45 years old, diabetes, lung and heart disease sufferers, smokers, heavy drinkers, those with poor immune systems and people with severe kidney or respiratory disease.
The bacteria occurs naturally in our ‘wild water’ such as rivers and lakes but it can also be found in our man made water systems. It is here, if conditions are favourable, the bacteria can grow and become a risk to the health of those using the water. People contract Legionnaire’s disease by inhaling minute droplets of water.
The Health and Safety Executive http://www.hse.gov.uk/legionnaires/what-you-must-do.htm states if you are ‘a person in control of the premises, you are responsible for health and safety and need to take the right precautions to reduce the risks of exposure to legionella.’ This includes landlords.
‘The Approved Code of Practice: Legionnaires’ disease: The control of Legionella bacteria in water systems (L8) [1] contains practical guidance on how to manage and control the risks in your system’ and will help you meet your obligations of the Health and Safety at Work Act 1974 (chapter 3).
HSE says ‘landlords need to be able to identify and assess sources of risk, manage any risks, prevent or control any risks, keep and maintain the correct records and carry out any other duties you may have’.
Identifying and assessing the risk
As the person responsible for the building it is your responsibility to appoint a competent person to carry out a risk assessment. It could be you or someone else but the assessor must have the necessary knowledge of your water system and its parts, your obligations, as the person responsible for the building, under the Health and Safety at Work Act 1974 an understanding of Legionellosis and how to minimise the risks.
What does an assessment include?
An assessment must include;
The name of the assessor and his or her competencies, the name of the person managing the building and therefore the water system, a description of the water system, any risks, how to minimise / control the risks, recommendations for monitoring and how often the system should be tested.

Before appointing an assessor, you must check they have sufficient skills and knowledge of your water system and of Legionellosis to carry out the assessment.
